General terms of subscription
These terms govern the relationship between La Charca Software S.L. («La Charca»), tax ID B90259185, registered at Calle Juan de Mata Carriazo, 3B, Local, 41018 Sevilla, and the nursery or person who takes out a subscription to My Nursery Manager («the Subscriber»).
In case of any discrepancy between versions, the Spanish version prevails.
1. Purpose
La Charca provides the Subscriber with the My Nursery Manager service: a web platform and mobile apps for managing nurseries and communicating with families, under the chosen subscription.
2. Subscription and trial period
The subscription is taken out through the platform. New nurseries have a free 30-day trial period, during which nothing is charged. Only people over 18 may subscribe, on their own behalf or on behalf of the organisation they represent. The Subscriber guarantees that the information provided is accurate.
3. Prices, taxes and payment
The current prices are those published on the pricing page and do not include taxes. VAT is applied as required by current law and the Subscriber's location. The amount depends on the number of children at the nursery with an enrolment in force. Payment is made in advance, monthly or annually, by card or SEPA Direct Debit, through Stripe.
4. Term, renewal and cancellation
The subscription renews automatically for periods equal to the one taken out. The Subscriber may cancel it at any time from their dashboard; cancellation takes effect at the end of the period already paid and does not entitle to a refund of that period. There is no minimum term.
If La Charca changes its prices, it will give sufficient notice and the new price will apply from the next renewal, so that the Subscriber can cancel beforehand if they do not agree.
5. Right of withdrawal
If the Subscriber is a consumer, they may withdraw within 14 calendar days of subscribing by notifying soporte@mynurserymanager.com. In that case, the unused proportion will be refunded.
6. Data protection
The nursery is the data controller for the data about its children, families and staff that it enters into the platform, and La Charca acts as data processor under Article 28 GDPR. Data is hosted in the European Union. More information in the privacy policy.
7. Availability and liability
La Charca takes reasonable steps to keep the service available and error-free, but cannot guarantee that there will be no interruptions due to maintenance, technical causes or third parties. Scheduled interruptions will take place outside nursery hours whenever possible.
8. Breach
If the Subscriber breaches these terms or fails to pay, La Charca may suspend or terminate the subscription. If La Charca is in breach and does not remedy it, the Subscriber may terminate the contract and receive the proportion of the unused period.
9. Intellectual property
The software and contents of My Nursery Manager not entered by the Subscriber belong to La Charca. The data, photos and documents entered by the nursery remain its own, and it may request a copy or their deletion.
10. Changes
La Charca may change these terms and will give sufficient notice by email or on the platform. Changes will apply from the next renewal.
11. Governing law
These terms are governed by Spanish law. The parties will try to settle any disagreement amicably before going to court.
